The historical land wrangle in Bulemezi has been drawn to near conclusion after Presidential Assistant Phiona Barungi advised that parties fall the law and warned against going against the existing court order.
" Am here to ensure that the court order is respected and no one can stop it.Court gave Kasule powers after going through this matter and he can use police officers from any part of Uganda to evict people occupying his land . Its not fair thatever since nothing has ever happened" said Ms Barungi.
The matter which is going on in the High Court Land Divion ,Kampala ,vide 0046/2024 arising from mescelenous case number 690 /2022 and also arising from civil suit numberb180 of 2005 is basically between the petitioners namely Musiime James and Kasule Samuel while Mubeezi James, Ntungire Stephen and Misaki Kavigi as respondents.
They are vying for the vaccant possession of of land comprised on Bulemeezi Block 981,plot 32,33,34 and 36, Land at Bukomero .
Balungi 's visit of the locus came after Mr Kavigi petitioned her office seeking assistance from president Yoweri Museveni after his neighbors ,Kasule in particular threatened his alleged land.
He allegedly told Ms Balungi that the court order which Mr Kasule and others are moving around with threatened his( Kavigi)ownership yet he also owns part of the said land.
Earlier Kaviigi had told the meeting that he owns the land though he has always found
resistance in occupying it .
But the court order which was read by the DPC Nakaseke SP Keneth Malenge at the locus gave right to Kasule to access his land.
However findings on locus showed that although Kavigi is a bonafide owner even the petitioners own part of that land and way forward was to respect the order.
In a special report prepared after the visit and copied to His excellence the president and all relevant authorities, it was discovered that there were subsisting execution proceedings vide EMA no 0046 of 2004 to implement the judgement and decree in High Court suit No 180 of2005 decree that; the defendants had fraudently acquired for themselves certificates of tittle arising out of formerly plot 4 Bulemezi Block981 partly belonging to Kasule Samuel's deceased father's estate.
It was further found out that Kasule as an adminstrator of his late father is entitled to 255 hectares out of 900.hectares formally in plot 4, Bulemezi, Block981 and now to be curved from.plots 16 and17 respectively.
This there fore meant that a certificate of tittle in the names of Kasule Samuel as an Adminstrator of the late Christopher Kasule be prepared and issued by the registrar of Tittles from the sub division of plots 16 and 17and Mr Kasule was awarded costs of the suit.
Further findings found that during the implementation of the decree there fresh certificates of tittle which were created and are now in Mr Kasule's possession thus Bulemezi block 981, plots 32,33,34,35 formerly plot16 and plots38,39,40,42 among others which was formerly plot17.
It was also un disputed that Kavigi and group have since paid Kasule the costs of the suit meaning the decree in civil suit No 180 of 2005 had been partially executed and all what was left was for the bailiff to hand over vaccant possession to Kasule.
While narrating his painful journey about this land, Kasule busted into tears while narrating to Barungi how he has suffered for over 20 years looking for justice, but had failed.
He said has a kidney problem and had wanted to sell off his land and go for surgery but had failed.
He added that Kaviigi and his team brought army on his land that couldn’t allow him to access his land andbstopped any thing he wished to do from his land.
It was advised that Mr Kavigi who petitioned MS Barungi ought to seek special help from.the president in his capacity as an old friend and possibly offers him.any personal help to get back to his feet.
