The special presidential Assistant on general duties has implemented the court order which restored the contested land in.Bunamwaya Kisigula in Makindye Ssabagabo municipality, Wakiso district to the Kaggwa family.
During a general locus meeting which attracted residents and tenants on this land,, Phiona Barungi called upon all parties to respect the court order saying no explanations out side court could stop the process.
The order issued by the Lady Justice Falavia Nassuna Matovu of the High court Land division emanating from civil suit No 416 of 2921 ordered that the plaintiffs were the rightful owners of the land in question.
It ordered that only a few of the sixteen defendants were bonefide occupants leaving out the rest to face immediate eviction.
It called upon the tenants to respect the Kaggwa family which owns the land and that all residents who are on the same land illegally get evicted.
However, the family members said they wanted to get in possession of all the vacant land but where there bonifide tenants then they gave them chance to pay for tittles while the illegal occupants were encouraged to put them selves proper.
Barungi initially said that the court order was satisfactorily done to even the lay person and called the worrying parties to settle for it but in case there was someone not satisfied she advised them to appeal to court.
The land in question sitting on Block 265 plot 285 at Bunamwaya,Kiisigula has been under contention between the family members of Kaggwa and other people who claimed to have bought plots from some family members rightfully.
Between the times after the death of their father George SK. Kaggwa , the administrators of this estate led by Mr Micheal Kaggwa started selling off plots which caused havoc on this land .
This disagreement led the matter to court where the administrators namely Kaggwa Micheal Ntovu, Namuwaya Margaret, Kaggwa Evelyne petitioned court against sixteen defendants who were claiming ownership of the plots on their land.
The defendants included Kalumba Muhamed, Nakaggwa Victor,Nkangi Ibrahim,Nagawa Betty, Kusinga Gilazio,Namuggabi Jackline,Kasagga Frank, Kabuye Mustapha,Kabuye Nangonzi Hamidah, Kaggwa Lamech,Ssempijha Patrick,Namakula Jane Kityo, Kinobe Twaha, Nankya Swanurah, Kizito Robert and Nantume Imelda respectively.
The family lawyer Hajji Qasim Ssekalema advised the beneficiaries to sort their differences and then handle tenants as a team because they are bonefide residents because they bought legally.
But the squatters led by George Mulumba ,said that they have gone through alot since 2014 when these land wrangles stared and the family has been changing lawyers making the process of regaining their tenancy complicated.
Some said have fought for their bibanja before paying for titles to the family members but they have been tossed since then because the tittle shows three names as owners led by Mr Micheal Kaggwa.
However, when it came to issuing their transfer forms, they started speaking otherwise saying the land was sold to them wrongly which brought a sharp divide between tenants and the family members.
Another tenant, Joseph Kagolo told Barungi that he bought in 2008 and was sold a plot before buying another plot from late Mulondo family
On his part, the Assistant RDC, Makindye Ssaabagabo,, Kavuma Sowedi urged residents to follow right proceedings when making land transactions noting that money is hard to earn and it should be given it's corresponding value by doing due diligence.
He however called for fairness when dealing with the family member who misled some tenants by selling them pieces of land which didn't belong to him. He said the law should take its course.
